Private investigation in Portsmouth hit the news today as a Portsmouth private investigator, Glenn Mulcaire, was arrested this week in connection with phone hacking and perverting the course of justice, according to reports.

The private investigator has previously served time in jail for hacking phones of royal aides on behalf of the News of the World. Police said that a 41-year-old man had been arrested, but refused to confirm his identity. Officers from Scotland Yard’s Operation Weeting said the man was arrested in London on suspicion of conspiring to intercept voicemail messages.

He was being held in custody at a south London police station, a spokesman said. The Metropolitan Police spokesman added: ‘On December 7, 2011 officers from Operation Weeting arrested a man in connection with phone hacking and perverting the course of justice.

‘At 7am officers arrested the man at an address in London on suspicion of conspiring to intercept voicemail messages, contrary to Section 1 (1) of the Criminal Law Act 1977 and on suspicion of perverting the course of justice contrary to common law. The man is currently in custody at a south London police station.
‘It would be inappropriate to discuss any further details at this time.’

This is the 18th arrest in Operation Weeting, which is investigating claims of phone-hacking at the News of the World.

However, no one has yet been charged as part of the £3million investigation.

A man was arrested on Tuesday after new claims that Tottenham Hotspur hired private investigators to snoop on West Ham and the Olympic Park Legacy Company during the Olympic Stadium bid.

The Metropolitan Police revealed that they had held the 29-year-old from Sussex after Baroness Ford, chair of the OPLC, attacked Spurs’ ‘vexatious’ behaviour and claimed that all 14 members of her board had been ‘put under surveillance’ by the club.

The man was arrested on suspicion of fraud offences and taken to a Sussex police station. Detectives from the Economic and Specialist Crime Command have also searched a home and business premises in Sussex, a second private address in Sutton, south west London, and a business in Westminster.

Baroness Ford told the London Assembly’s economy, culture and sport committee, who are responsible for scrutinising the Olympics on behalf of the Assembly: ‘My board were put under surveillance by Tottenham Hotspur and the chairman of Tottenham Hotspur felt confident enough to say in The Sunday Times several months ago that all 14 members of my board were put under surveillance.

‘The Metropolitan Police are now conducting an investigation into that surveillance. There has been all kinds of behaviour here that I could not have anticipated which, believe me, has not been pleasant in the last 12 months.’

A Tottenham statement, issued through the club’s lawyers, insisted the accusations were ‘wholly inappropriate and irresponsible’.

It added: ‘The club did not undertake, instruct or engage any party to conduct surveillance on any member of the OPLC committee. We totally reject the accusation in the strongest possible terms.’

Tottenham lost out to West Ham in their bid to take over the Olympic Stadium in February. The OPLC have launched a new tendering process.

Of course, there are moments that get the heart racing, but a good private investigator is definitely seen and not heard.

In the course of seeing what my private eye competition was doing, I naturally research the industry I am in too and come across numerous documents and videos. After all, it’s essential to stay abreast of developments and laws, and so I do this frequently.

Below you’ll find some of the more interesting movies I have come across.

Monty Python star John Cleese has accused the country’s most high-profile divorce lawyer of wasting thousands of pounds of his money on private detectives to find out where he was living, according to the Mail.

Cleese says Fiona Shackleton, who advised his former wife during his divorce, hired private investigators to track him down to a London hotel so that his personal assistant Garry Scott-Irvine could be served with legal papers. Mr Scott-Irvine was staying with him at the time.

But the veteran actor says his whereabouts were well known after he had separated from his third wife, American Alyce Faye Eichelberger, in 2008.

And the Fawlty Towers creator complains the use of a private investigator bumped up the final legal bill of £1.25 million. As part of the settlement, Cleese paid his own and his ex-wife’s costs.

The 71-year-old star said: ‘That summer they wanted to serve a document on Garry, saying that he was going to have to testify in the United States, which we knew he was going to do.

Alyce Faye and her lawyer had his email address, so they could have said, “Where are you so that we can serve this document on you?” But instead, Alyce Faye’s lawyer hired Fiona Shackleton and Fiona Shackleton hired a private detective.

“It was an example of something that happened all the way through. You felt that the lawyers were quite deliberately spending as much
of my money as they could. Why? Because they could.”

In September 2008, several months after separating from Ms Eichelberger, Cleese moved into the Covent Garden Hotel in Central London.

Mr Scott-Irvine was served with the papers on September 18th.

Cleese said: “Everybody connected with me and Garry knew we were there. So it could have been done in an instant with no cost at all. But they hired a private detective because it meant three people got fees and, of course, I paid for them.”

Sources close to Baroness Shackleton, who famously represented Prince Charles, Madonna and Sir Paul McCartney in their divorces, confirmed that she may have employed a private investigator but insisted this was only to serve papers, not to find Cleese.

However, Mr Scott-Irvine said the lawyer’s bill clearly identified two figures – one for the cost of a process server and one for a private investigator. “In any case, it was awful lot of money just to serve some legal papers,” he said.

Cleese’s divorce, finalised in the United States in 2009, cost him £12 million which he says he is still paying for. He said he did not complain about the costs aspect at the time because he did not know what was being charged by his wife’s lawyers until the bill arrived.

Ms Shackleton was made a Tory peer last December, taking the title Baroness Shackleton of Belgravia.

She has a fearsome reputation and is known in legal circles as the Steel Magnolia. During McCartney’s divorce battle with Heather Mills she famously had a jug of water poured over her head in the High Court by Ms Mills.

Baroness Shackleton also advised on Cleese’s pre-nuptial agreement before he married Ms Eichelberger in 1992, charging up to £40,000.

A source close to Baroness Shackleton said last night that there was no question of a private investigator being hired to find Cleese, but an investigator was employed to act only as a process server to satisfy the formal procedure required in a case involving service in a foreign jurisdiction.

It is also understood that psychotherapist Ms Eichelberger, 66, was happy with all the advice she received from Baroness Shackleton. Cleese is now dating jewellery designer Jennifer Wade, who is 31 years his junior.

Just when you thought you had heard it all, author Mira Kirshembaum – who claims to have 30 years’ experience as a marriage therapist- says the ‘right kind’ of affair can be a positive thing, acting to “jolt people from their inertia”.

Of course, this wouldn’t have anything to do with the book she released, entitled When Good People Have Affairs, would it? The book talks of how society has so far failed to have a sympathetic discussion of infidelity, the positive sides of cheating have been ignored.

However, Mira insists that most cheating spouses should never own up, because revealing the infidelity is more damaging than keeping quiet.

“Sometimes an affair can be the best way for the person who has been unfaithful to get the information and impetus to change,” she said.

“I’m not encouraging affairs, but underlying the complicated mess is a kind of deep and delicate wisdom. It’s an insight that something isn’t working and needs to change.”

Most philanderers are good, kind people, she argues, who are seeking real happiness and love.

Ms Kirshenbaum, clinical director of the Chestnut Hill Institute, a psychotherapy and research centre in Boston, Massachusetts, says her book is not aimed at ‘creeps’ who think they can cheat with impunity, but at decent people who know they have made a mistake.

“These people are suffering terribly and need to be relieved of their sense of guilt and shame because those emotions are paralysing,” she said.

“If handled right, an affair can be therapeutic, give clarity and jolt people from their inertia,” she said.

“You could think of it as a radical but necessary medical procedure. If your marriage is in cardiac arrest, an affair can be a defibrillator.”

But she is convinced that an adulterer must never confess, not even if their partner asks directly.

“This is the one area in which the truth usually creates far more damage in the long run,” she said.

“If you care that much about honesty, figure out who you want to be with, commit to that relationship and devote the rest of your life to making it the most honest relationship you can.”

Her sympathetic approach to cheats has been criticised by some of her peers.

Phillip Hodson, fellow of the British Association for Counsellors and Psychotherapists said: “We mustn’t underestimate the immediate grief caused by an affair.

“The last thing people want to hear if their partner has had an affair is any sympathy offered to the person who they feel has betrayed them, and acted like a snake in the grass.

“However, when they look back in five or ten years, they might take a different view.

“Maybe this book goes too far, but we do need to take a sociological view of affairs. To think, ‘what are we going to do about them?’ rather than to say ‘it can’t happen’, when it clearly does.”

In many ways, cheating simply involves betraying a partner’s expectations as to what’s acceptable behaviour in a relationship. When a husband or wife, boyfriend or girlfriend, violates that expectation about what is appropriate, people feel betrayed. Keep in mind that relationships are not based on logic, but they are generally influenced by our emotions.

Accordingly, cheating is difficult to really define because people differ in the type of contact they feel it is appropriate for a partner to have with someone else.

For example, many people believe that it is unacceptable for a partner to:

Flirt with other men or women

Engage in sexual talk with someone other than their partner

Exchange personal e-mails or text messages with another person

Deny being married or in a relationship, even on Social networks

Spend time with specific individuals that may pose a threat

Engage in specific types of contact, for instance, sleeping in the same bed with another person, even the same sex

Purchase gifts and presents for others

Chat online with friends

Have physical contact with someone else

Become emotionally attached to someone else

Develop feelings for another individual

Share private thoughts and feelings with someone else

Become good friends with someone of the opposite sex

Again, the main point here is that individuals differ in what they consider to be an acceptable form of contact with other people.

On one side, some couples think it is acceptable to have sex and fall in love with someone else, while some people view flirting with another person as being inappropriate.

Cheating is generally complex because the definition varies so wildly. However, when someone violates a partner’s expectations, the emotional outcome is the same – their partner feels betrayed and rejected.

Cheating is also problematic because many couples rarely discuss exactly what their expectations are.

So in any given relationship, what one person considers to be acceptable, another person may find the opposite. Problems arise in relationships because people do not see eye-to-eye on this issue.

And to make matters worse, many people do not like to define what counts as cheating. Many people prefer not to define what counts as cheating because by keeping the rules vague and ambiguous, it makes it easier to cheat. If you don’t know what the rules are, you really can’t break them – or so people like to think.

It is a lot easier to deceive yourself, or your partner about cheating, when the rules themselves are not clear.

Following our information on cheating husbands on faithful women, we thought we would reverse the roles.

Woman cheating isn’t as common, but the following facts may interest you.

Women are much less likely to cheat than men. While estimates of infidelity are difficult to establish, surveys consistently reveal that wives tend to be more faithful than husbands.

When a wife cheats on her husband, she is more likely to have an emotional affair. Women are less likely than men to have a one night stand.

Due to women being more likely to have an emotional affair, cheating wives tend to cheat with someone who is part of their social group – a friend, a co-worker, someone from school, church, etc.

A cheating wife is also more likely to have affairs with men who have more status and resources than their husbands. Or women cheat with men who are better relational partners – someone who is more attentive, appreciative and understanding.

A cheating wife is also much more likely to consider leaving her husband when she is having an affair. Because female infidelity tends to be based on emotional intimacy, women often attach more significance to an affair.

When women do cheat, they are also more likely to view their infidelity as a symptom of the problems in their relationship. By comparison, men have an easier time separating infidelity from the problems they face at home.

Women are also generally more likely to draw positive inferences about their physical appearance when they are cheating (e.g., I’m still attractive, I’m still desirable, etc.).

In the event that a woman does have a one night stand, it tends to be with someone who is more attractive and physically fit than her husband.

Women are also generally much more likely than men to use cheating as a means of getting revenge. While using infidelity to “get even” is rare, “revenge cheating” is more common among women.

Most people at one point or another have wondered about a cheating spouse.

For women suspecting unfaithful husbands, the following pieces of information concerning infidelity should be of use:

Men are much more likely than women to cheat. It is estimated that close to 50% of all men will cheat at some point in their lives.

Husbands are also far more likely to engage in online cheating – using chat rooms, webcams and online services to arrange sexual encounters (including prostitution).

The more money a husband generally makes, the more likely he is to be unfaithful. Having more money brings more opportunity and wealth tends to attract more women.

A lack of sexual excitement or the same routine of having sex with the same person often leads men to stray. Men are more likely to be drawn to the thrill of having sex with someone new.

Husbands are much less likely than wives to consider leaving their spouse when having an affair.

A cheating husband is much more likely to have an affair with someone who is younger than his wife.

When having a one-night stand, most men are less choosy than women when it comes to selecting someone to have sex with.

Husbands are generally more likely to feel that cheating is justified due to the lack of sex within a marriage.

Husbands are always more likely than wives to be serial cheaters.

A New York man claimed he found out that his cheating wife was having an affair after using an app he installed on her iPhone to spy on her.

Thomas Metz said he was able to track his unfaithful wife’s movements using the Find My Friends app on her phone, according to sources.

Mr Metz said he had grown suspicious of his wife’s infidelity and tested her by texting her to ask what she was doing. She replied, saying she was with a friend on 10th Street, Manhattan.

Mr Metz said that he knew this was not true by using the app to ascertain that she was actually three miles away from where she said she was.

“I got my wife a new 4s and loaded up Find My Friends without her knowing. She told me she was at her friend’s house in the east village. I’ve had suspicions about her meeting this guy who lives uptown. Lo and behold, Find My Friends has her right there,” Mr Metz was quoted as saying by the MacRumor website.

“I just texted her asking where she was and the dumb b—- said she was on 10th Street.

“Thank you Apple, thank you App Store, thank you all. These beautiful treasure trove of screen shots going to play well when I meet her at the lawyer’s office in a few weeks.”

The story has provoked a mixed reaction, with some people doubting whether it actually happened. Other comments were critical of Mr Metz’s tactics: “Are you stupid? … I bet there aren’t many men here who have never lied to their wives about where they were,” one online commenter wrote.

Private investigators can be useful if you need information about your partner that you find it difficult or impossible to obtain by yourself. There are a number of ways both legal and illegal, in which private investigators can go about obtaining proof of infidelity, the existence of hidden bank accounts and other information that may not be out in the open.

Adultery Cases

If you petition for divorce on the grounds of adultery, then unless your partner admits to it, you will need to provide evidence. A direct approach would be for an investigator to knock on the couple’s door and interview them on their sleeping arrangements. Or they could spy on the couple and make a record of when they go to sleep and when they get up. Other evidence like letters, diaries, photographic or recorded audio evidence can also be obtained if desired.

If your partner has moved out but you want stronger grounds for divorce than separation, you could hire an investigator to obtain proof of adultery. A good private investigator will be aware of the Data Protection Act and related laws, and will work within them. If you want to bug your partner’s phone, for example, you may be better protected doing it yourself than asking a P.I., although a P.I. should be able to tell you where to buy a decent bug.

Unreasonable Behaviour

Generally if you file for divorce on the basis of unreasonable behaviour, you will not have to provide proof unless the case is fully defended. If you choose to, you can hire an investigator to prove your partner is being violent. They could even visit your home and let your partner know. You set the parameters and a good private investigator will not stray beyond them.

You might also want to prove your partner is habitually neglecting the family, or that they are verbally abusive. They might drink and drive with the children in the car. Unreasonable behaviour can also cover extra-marital sexual activity or close association that falls short of adultery. Hiring a private investigator to prove these facts can save you the pain of having to question your partner or delve into it yourself.

Uncovering Hidden Assets

A common reason investigators are hired in divorce cases is to obtain proof that a husband has hidden bank accounts or other assets from their wife. Information like bank balances can be obtained in a number of ways. If the investigator hacked into a computer to get the information it would be classed as “blagging”, which is illegal. But if someone told them or they just happened to guess the bank balance, it would not. A range of options are open to an investigator, so you should discuss in detail how you want the investigation conducted when you hire them.

Other Information

Similar laws apply to acquiring other information such as ex-directory telephone numbers and a host of background information like schooling and family trees. You might also want to find out if your partner has any convictions, or obtain information about their former partners. A good private investigator will be able to dig up a surprising amount of information, whether or not it directly applies to your divorce.
